According to a fax received from Amnesty
International on 29 May 1995, while there are penalties for
homosexual acts stipulated in the Malaysian Penal Code and in the
laws of several states, AI researchers are unable to state whether
or not these laws are enforced. For additional information, please
consult the attachment. A review of AI documents on homosexuality
available at Regional Documentation Centres revealed no additional
information concerning the situation of homosexuals in
Malaysia.
This Response was prepared after
researching publicly accessible information currently available to
the DIRB within time constraints. This Response is not, and does
not purport to be, conclusive as to the merit of any particular
claim to refugee status or asylum.
