Whether a minor child who was born abroad can obtain residence in France if its mother obtained her residence card after having married a French citizen [FRA38507.FE]

According to the Service-Public.fr Website, the French government's Web portal, those who have the right to a residence card for non-Community foreigners include:

[translation]
the spouse and any children under 19 years of age of a foreigner with a residence card who have been authorized to stay in France by virtue of family reunification (2000).

According the French SOS-Net Website, [translation] "the largest public legal database in France" (n.d.), non-Community foreign residents do not include nationals from the European Union (EU) or countries belonging to the European Economic Area (EEA) (17 Dec. 2001).

According to the same Website, [translation] "[the] foreign child of a French citizen, who is married if the child is under 21 years of age or if the child is a dependant of the parents," is included in the list of persons to whom a residence card shall be issued as of right, provided [translation] "a parent-child relationship and the French citizenship of one of the parents can be proven" (SOS-Net 30 Dec. 2001).
