Copy of the section of the Chinese Criminal Law on search summons, issued by the Public Security Bureau [CHN8238]
The copy of the Chinese Criminal Law currently available to the
IRBDC does not have a section on search summons issued by the
Public Security Bureau. However, attached please find a copy of the
Criminal Procedure Law of the People's Republic of China which
includes sections 3, 4 and 7 regarding search warrants and the role
of the PSB in searching process.
Also attached please find an article on China's criminal justice
system which refers to the process of prosecution of a Chinese
dissident for whom no arrest warrant was issued despite the
stipulation to that affect in the Criminal Procedure Law ("China's
Changing Criminal Justice", September 1988, 267-268).
A copy of a summon issued by the PSB is currently unavailable to
the IRBDC.
