Kurzbeschreibungen zu den in dieser Anfragebeantwortung verwendeten Quellen sowie Ausschnitte mit Informationen aus diesen Quellen finden Sie im Anhang.

Das Online OCI (Overseas Citizen of India) Service schreibt auf seiner Webseite, dass ein minderjähriges Kind mit ausländischer Staatsbürgerschaft und einem oder beiden Elternteilen mit indischer Staatsbürgerschaft berechtigt sei, sich als OCI-Karteninhaber·in zu registrieren. Eine Ausnahme würden Personen darstellen, die selbst, deren Eltern, Großeltern oder Urgroßeltern Staatsbürger·innen Pakistans, Bangladeschs oder eines anderen von der Zentralregierung per Bekanntmachung im Amtsblatt festgelegten Landes sind oder waren (Online OCI Services, ohne Datum; siehe auch: VFS Global, ohne Datum, vergleiche: EOI Vienna, ohne Datum).

 

Die indische Botschaft in Wien fügt auf ihrer Webseite hinzu, dass minderjährige Kinder, die bereits einen PIO (Person of Indian Origin)-Status hätten nicht berechtigt seien, um eine OCI-Karte anzusuchen. Außerdem seien indische Staatsbürger·innen, denen in einem anderen Land Asyl gewährt worden sei, vom OCI-System ausgenommen. Für einen Antrag auf eine OCI-Karte für minderjährige Kinder würden folgende Dokumente benötigt:

·       OCI-Registrierungsformular (Teil A&B ordnungsgemäß online ausgefüllt und vom/von der Antragsteller·in unterzeichnet). Wenn Minderjährige nicht in der Lage seien zu schreiben, solle ein Mädchen seinen linken Daumenabdruck und ein Junge seinen rechten Daumenabdruck abgeben. Das Formular B sei bei Minderjährigen von beiden Elternteilen gegenzuzeichnen.

·       Zwei aktuelle Fotos im Format 51x51 Millimeter ohne Rand, die den Kopf/Schultern des Antragstellers/der Antragsteller·in in voller Frontalansicht zeige, weißer/heller Hintergrund. Keine Blendung beim Tragen einer Brille.

·       Bescheinigung über die Rückgabe des Reisepasses / Bescheinigung des Verzichts der indischen Staatsbürgerschaft

·       Kopie der OCI-Karte, Bescheinigung über die Rückgabe des Reisepasses / Bescheinigung des Verzichts der indischen Staatsbürgerschaft der Eltern

·       Kopie der Geburtsurkunde des minderjährigen Kindes mit den Namen beider Elternteile (Dokument mit Apostille).

·       Heiratsurkunde der Eltern

·       Kopie des Meldezettels

·       Kopie des Staatsbürgerschaftsnachweises

·       (Einbürgerungsurkunde)

·       Namensänderungsurkunde, im Falle einer Namens-/Nachnamensänderung, Änderung des Aussehens

·       Kopie des österreichischen Reisepasses

Als Teil des Antrages seien beglaubigte Kopien der notwendigen Dokumente einzureichen. Die Originaldokumente seien zur Überprüfung vorzulegen. Beglaubigte Dokumente würden nur akzeptiert, wenn Antragsteller·innen keine Originaldokumente vorlegen könnten. Der Antrag (bestehenden aus ausgedrucktem Antragsformular und den genannten Dokumenten) sei an Werktagen zwischen 9:30 Uhr und 11:30 Uhr zusammen mit der entsprechenden Gebühr bei der Konsularabteilung der indischen Botschaft in Wien einzureichen.

Die Registrierung eines/r OCI-Karteninhaber·in koste 230 Euro. Hinzu komme ein Zuschlag von 3 Euro zugunsten des Indian Community Welfare Fund (ICWF).

Die Bearbeitung würde normalerweise fünf bis sechs Wochen ab Datum der Antragstellung dauern. Antragsteller·innen könnten den Status ihrer Anträge online (unter https://ociservices.gov.in/statusEnqury) einsehen (EOI Vienna, ohne Datum).

 

Das Kölner Visum Zentrum (KVZ), ein Privatunternehmen, das bei der Beschaffung von Visa und ähnlichen Dokumenten unterstützt, schreibt auf seiner Webseite folgendes:

„Ob und wann ein[e] OCI Karte ausgestellt wird, liegt im alleinigen Ermessen des Indischen Generalkonsulats.“ (KVZ, ohne Datum)

Es konnten keine Informationen zu etwaigen Problemen bei der Ausstellung einer OCI-Karte für Kinder, deren Eltern einer unteren Kaste in Indien angehören, gefunden werden. Gesucht wurde auf Deutsch und Englisch mittels ecoi.net, Factiva und Google nach einer Kombination aus folgenden Suchbegriffen: Indien, OCI Karte, abgelehnt, Gründe, Diskriminierung, Kaste, Dalit.

OCI Registration Form (part A&B duly filled online and signed by the applicant). If minors are not capable of writing then it should have Left thumb impression in respect of girl child and Right Thumb Impression in respect of boy child. The From B in respect of minors is to be countersigned by both parents.
