Gemäß Artikel 205.4 Abs. 2 des Strafgesetzbuches der Russischen Föderation wird „Beteiligung an einer terroristischen Vereinigung“ mit einer Freiheitsstrafe von fünf bis zehn Jahren bestraft. Zusätzlich kann eine Geldstrafe von bis zu 500.000 Rubel oder in Höhe des Lohns oder sonstigen Einkommens des Verurteilten, das einem Zeitraum von bis zu drei Jahren entspricht, verhängt werden. (Strafgesetzbuch der Russischen Föderation: 5. Juni 1996, Fassung vom 11. Juni 2021, Art. 205.4, Abs. 2)

Gemäß Artikel 205.5 Abs. 2 des Strafgesetzbuches wird „Beteiligung an Aktivitäten einer Organisation, die nach den Gesetzen der Russischen Föderation als terroristisch eingestuft wird“ mit einer Freiheitsstrafe von zehn bis zwanzig Jahren bestraft. Zusätzlich kann eine Geldstrafe von bis zu 500.000 Rubel oder in Höhe des Lohns oder sonstigen Einkommens des Verurteilten, das einem Zeitraum von bis zu drei Jahren entspricht, verhängt werden. Zu den Bestimmungen des Artikels 205.5 Abs. 2 wird im selben Gesetzbuch angemerkt, dass in Fällen, in denen eine Person diese Straftat zum ersten Mal begangen hat und ihre Beteiligung an einer solchen Organisation freiwillig (d. h. vor dem Zeitpunkt ihrer Festnahme bzw. der wissentlichen Einleitung von Ermittlungs- oder anderer Verfahren) beendet hat, diese Person nicht bestraft wird, sofern ihre Handlungen keine weiteren Straftatbestände erfüllen. Es wurden folgende Berichte zu Verurteilungen von Personen gefunden, denen Mitgliedschaft bzw. Mitwirkung in einer terroristischen Organisation vorgeworfen wurde:

Wie Caucasian Knot berichtet, verurteilte ein Gericht in Rostow am Don im November 2020 vier aus Dagestan stammende Personen wegen mutmaßlicher Planung eines Terroranschlags auf ein Konzert in Machatschkala im Jahr 2017 zu jeweils 19, 18 17 und zehn Jahren Haft in einer Strafkolonie. Nach Angaben von Ermittlern seien sie Mitglieder einer Schläferzelle der Gruppe Islamischer Staat gewesen. (Caucasian Knot, 23. November 2020)

Ende März 2020 berichtete die Jamestown Foundation, dass das Militärgericht des Bezirks Süd in Rostow am Don kürzlich einen Bewohner Dagestans, Biysoltan Dschamalow, wegen Terrorismus und Beteiligung an Aktivitäten einer illegalen bewaffneten Gruppe in Syrien zu zwölf Jahren Haft verurteilt habe. Wie die Quelle erläutert, habe die russische Regierung einige Jahre zuvor alle russischen Staatsangehörigen, die in Syrien gegen die Assad-Regierung kämpften, als „Terroristen“ eingestuft. Nach Angaben russischer Ermittler habe sich Dschamalow im Jahr 2016 der Gruppierung „Jabhat al-Nusra“ und im Folgejahr der arabisch-nordkaukasischen Gruppierung „Jaish al-Muhajirin wal-Ansar“ (damals eine Untergruppe der Jabhat al-Nusra) angeschlossen. Er sei im Mai 2019 vom russischen Inlandsgeheimdienst FSB verhaftet worden, nachdem er aus der Türkei nach Russland abgeschoben worden sei. Berichten zufolge habe er sich auf der Fahndungsliste der föderalen Behörden befunden, mit der Begründung, er habe sich der Gruppe Islamischer Staat angeschlossen. Ebenfalls im März 2020 habe dasselbe Militärgericht die Brüder Muchtar und Ismail Kurbanow wegen Mitgliedschaft in einer illegalen bewaffneten Gruppierung sowie in einer terroristischen Organisation zu 15 bzw. 17 Jahren Haft in einer Strafkolonie verurteilt. Wie Caucasian Knot berichtet sei die Strafanwaltschaft der Auffassung, dass sie Mitglieder einer dagestanischen Extremistengruppe gewesen seien und in den Jahren 2014–2016 auf Seiten des Islamischen Staates in Syrien gekämpft hätten. Dasselbe Gericht habe im Dezember 2019 den Tschetschenen Jakub Ibragimow zu 19 Jahren Haft in einer Strafkolonie verurteilt. Nach Angaben der Staatsanwaltschaft sei er im Jahr 2014 in einem Ausbildungszentrum der Gruppe Islamischer Staat ausgebildet worden, so Caucasian Knot. (Caucasian Knot, 11. Dezember 2019)

Wie Caucasian Knot berichtet, habe dasselbe Gericht (hier als Militärgericht des Bezirks Nordkaukasus bezeichnet) den aus der Stadt Wladikawkas in der Republik Nordossetien-Alanien stammenden Timur Tumgoew zu 18 Jahren Haft in einer Strafkolonie verurteilt. Das Gericht habe befunden, dass er Mitglied einer extremistischen Gruppierung in Syrien sei. Ermittlern zufolge habe er sich in Syrien der Gruppe „Jaish al-Muhajirin wal-Ansar“ angeschlossen, die als Teil des Islamischen Staates angesehen werde. Er sei im Juni 2016 in der Ukraine verhaftet und im September 2018 auf Antrag des FSB nach Russland ausgeliefert worden. (Caucasian Knot, 26.Juni 2019)

Dieses Urteil wurde laut Caucasian Knot im Oktober 2019 durch den Obersten Gerichtshof der Russischen Föderation bestätigt (Caucasian Knot, 16. Oktober 2019).

„Today, the North-Caucasian District Military Court in Rostov-on-Don has found Timur Tumgoev, a native of Vladikavkaz, to be a member of a group of Syrian militants and sentenced him to 18 years in a high-security colony.

The 'Caucasian Knot‘ has reported that the prosecutor demanded to imprison Tumgoev for 19 years. His defence, in its turn, has stated that Tumgoev's guilt was not proved and asked to acquit him. The defendant himself, in his last plea, called the accusation unfair; however, he expressed his readiness to go to the colony ‘by the will of Allah.’

According to investigators, in October 2014, Timur Tumgoev went to Georgia, then to Turkey, and from there to Syria, where he joined the militants of the grouping ‘Djeish al-Muhajirin Wal-Ansar’, treated by the prosecution as a be part of the ‘Islamic State’ (IS), a terrorist organization banned in Russia by the court. Timur Tumgoev himself has admitted only the fact of his stay in Turkey. Tumgoev was detained in June 2016 at Kharkov Airport, where he had flown from Turkey. „On December 10, the Southern Military Court sentenced Yakub Ibragimov, a native of Chechnya, to 19 years of imprisonment in a penal colony. According to public prosecutors, the man was trained at a special centre of theIslamic State’ (ISIL, a terrorist organization, banned in Russia by the court, – note of the "Caucasian Knot"). Yakub Ibragimov declared self-incrimination after torture and threats.

According to investigators, in the period from July to August 2014, Yakub Ibragimov stayed at the IS training centre, where he learned how to handle weapons, explosive devices and substances.

The ‘Caucasian Knot‘ has reported that on March 17, 2020, the Southern District Military Court found both defendants to be members of an illegal armed formation (IAF) in Dagestan and Syria, as well as members of a terrorist organization, and sentenced them to imprisonment: Ismail for 15 and Mukhtar for 17 years in a maximum security colony.

Prosecutors believes Mukhtar and Ismail Kurbanov were members of the ‚Makhachkala‘ grouping of militants and fought on the side of the IS (ISIL, a terrorist organization, banned in Russia by the court, – note of the "Caucasian Knot") in Syria in 2014-2016. „In Rostov-on-Don, a court found four natives of Dagestan guilty of plotting a terror act at a Philipp Kirkorov's concert in Makhachkala in 2017. „The Russian Southern District Military Court, in the city of Rostov-on-Don, recently sentenced Biysoltan Jamalov, a resident of Dagestan, to 12 years in prison on charges of terrorism and participation in the activities of an ‘illegal‘ armed group in Syria. Several years ago, the Russian government dispatched its Armed Forces and private military companies (PMC) to Syria to prop up President Bashar al-Assad. At the same time, Moscow designated all Russian citizens who fought against the Syrian government as ‘terrorists.‘ According to the Russian officials, Jamalov joined the militant group Jabhat al-Nusra (‘Front of the Supporters’) in 2016. In 2017, he reportedly became a member of the Arab–North Caucasus militant group Jaish al-Muhajirin wal-Ansar (‘Army of Emigrants and Supporters’), which was itself part of Jabhat al-Nusra at the time. The charges against Jamalov say that he guarded the territories controlled by these rebel groups in the suburbs of Idlib and other places in the Syrian province of Latakia. The man was apprehended in April 2019 (TASS, March 18).

A regional Dagestani news agency reported on May 4, 2019, that the Federal Security Service (FSB) had detained a ‘dangerous terrorist,‘ Biysoltan Jamalov, at the airport in Makhachkala. According to the official Information, 31-year-old Jamalov had been deported from Turkey to Russia. Jamalov reportedly had been on the Russian federal search list for having joined the extremist Islamic State (IS) (Riadagestan.ru, May 4, 2019).“ (Jamestown Foundation, 25. März 2020)
