Information indicating whether the 15th brigade of the Hammurabi Division of the Iraqi army was involved in the taking of Kuwait in 1990; if such is the case, information indicating whether the division committed crimes such as assassination, pillage, rape, torture, etc. [KWT35920.FE]

No information indicating whether the 15th brigade of the Hammurabi Division of the Iraqi army was involved in the capture of Kuwait in 1990 was found in the sources consulted by the Research Directorate.

However, a book published by the U.S. Army Center of Military History entitled The Whirlwind War states that the Hammurabi Division, as part of the 1st subcorps group of the Iraqi Republican Guard, was deployed in southern Iraq and northern Kuwait (1995).

In addition, in a thesis submitted to the School of Advanced Airpower Studies, Major Andrews stated that on 3 August 1990, Iraqi troops conducted "an overwhelming combined arms assault" on Kuwait, reaching the capital in less than five hours. Within two days, Iraq had completely overrun Kuwait (ibid.). The Hammurabi Division was involved in the fighting (ibid.).

For information on the crimes committed by Iraqi troops during the invasion of Kuwait, see the Amnesty International document entitled Iraq-occupied Kuwait: Human Rights Violations since 2 August 1990, which is available in the regional documentation centres.

This Response was prepared by the Research Directorate after researching publicly available information currently available to the Directorate within time constraints. This Response is not, nor does it purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
