Information on whether taking one's own child out of the country contrary to a custody order and/or keeping the child in another country after custody has been granted to the U.S. party are considered offences, and if so, on whether these offences are treated as criminal or civil matters, and on charges laid and sentences imposed [USA20548.E]

For information on the above-mentioned subject, please refer to the attached letter faxed to the DIRB on 5 May 1995, which includes an excerpt from the United States International Parental Kidnapping Act. According to an official of the Criminal Division of the United States Department of Justice, this law was passed by the United States Congress in 1993 (30 May 1995). Also please refer to the state criminal parental abduction statutes and the U.S. International Child Abduction Remedies Act, and other pieces of relevant U.S. legislation attached to Response to Information Request USA20507.E of 6 June 1995.
