Information on whether a child born in India of non-Indian parents who were in the country illegally, would be entitled to Indian citizenship by virtue of birth [IND16900.E]

According to an official of the High Commission for India in Ottawa, Indian citizenship is not granted solely by virtue of being born in India (14 Mar. 1994). The source stated that the mother or father would have to be Indian citizens or of Indian origin. He added that it is irrelevant whether the child's parents were in India illegally at the time of the birth.
